Did you buy this bike new? What year is it? Do you have the records to prove
it has always been serviced by a BMW dealer? Your reply to Tom says to me
that you already have all the answers, so I don't understand why you are
questioning this list. If this was a case of a true "lemon", I am confident
BMW would have stepped in and made things right; they have a glorious track
record for doing so. The way you tell the story sounds like they don't want
to touch your bike even with someone else's stick. That tells me that there
is more to this story than what we've read.
Trade your "dog" to the dealer for the new RS: The deal is a no brainer.
